Terms of Service

These Terms of Service ("Terms") govern your use of ithil.software and the Ithil MCP Gateway software, operated by Crossland Creative LLC ("we", "us", or "our"). By accessing the site or using the software, you agree to these Terms.

1. The Software License

Ithil is licensed under the Business Source License 1.1 (BSL 1.1). Your use of the Ithil software is governed by that license, not solely by these Terms.

• Non-commercial use is free. This includes personal projects, open-source projects, research, and internal evaluation. A free license key is required and available at no cost.
• Commercial use  requires a paid commercial license at $149/month. "Commercial use" means any production use in a product or service that generates revenue or is used in a commercial context.
• Using Ithil commercially without a valid commercial license is a violation of the BSL 1.1 and these Terms.

2. License Keys

Upon obtaining a license (free or commercial), we will issue you a signed license key delivered to your email address. You are responsible for keeping your license key secure. Do not share your commercial license key publicly or with unauthorized parties.

One commercial license covers your entire team and unlimited production deployments. You may not resell or sublicense your key.

3. Subscriptions and Billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

By completing a purchase you also agree to Paddle's Buyer Terms.

• Commercial licenses are billed monthly at $149/month.
• Subscriptions renew automatically unless cancelled before the next billing date.
• You may cancel at any time. To avoid being charged for a renewal, cancel at least 48 hours before your next billing date. Cancellation takes effect at the end of the current billing period and you retain access until then.
• We reserve the right to change pricing with 30 days notice to active subscribers.

4. Refund Policy

Because Paddle is the Merchant of Record, all refunds are governed by Paddle's Buyer Terms. In summary:

• You have a statutory right to withdraw within 14 days of purchase, unless you have already downloaded, installed, or begun using your license key and gave express consent to waive this right at checkout.
• Outside the statutory window, Paddle may issue a refund at its sole discretion if a request is submitted within 30 days of the order date. This is not guaranteed.
• Refund requests must be submitted directly to Paddle at paddle.net or via your Paddle payment confirmation email.

5. Acceptable Use

You agree not to:

• Use Ithil in violation of the BSL 1.1 license terms
• Attempt to circumvent or remove license key validation
• Reverse engineer the license key signing mechanism
• Use the site or software for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' data

6. Self-Hosted Software

Ithil is self-hosted software. You are responsible for your own infrastructure, security, and compliance when deploying Ithil. We are not responsible for how you configure or operate the software within your environment.

7. Disclaimer of Warranties

Ithil is provided "as is" without warranty of any kind, express or implied. We do not warrant that the software will be error-free, uninterrupted, or meet your specific requirements. Use it at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Crossland Creative LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Ithil or these Terms. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the State of Oklahoma, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Oklahoma.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the site or software after changes constitutes acceptance of the new Terms. Material changes will be communicated via email to active license holders with at least 14 days notice.
